Nuisance calls and texts; the real enemy of the state

The Association of Personal Injury Lawyers (APIL) has predicted that nuisance calls and texts are to reach epidemic levels under the Government whiplash and small claims limit reform proposals.

As the insurance and personal injury sectors wait with baited breath to hear the results of the latest consultation into personal injury reform and the proposed increase to the small claims limit from £1,000 to £5,000, the real villains of the story are sitting pretty.

APIL’s president, Neil Sugarman, has warned of a major influx of spam calls and texts from CMCs touting for business. Sugarman feels that we should be concentrating on the scourge of nuisance callers instead of pushing ahead with the reforms. He said:

“Cold calling is at the very core of misconceptions about claiming for personal injury, and is at the root of these unfair and unnecessary proposals. Cold calling is universally detested yet the government would rather punish genuinely injured people than tackle the real problem.”

Mass Chair Simon Stanfield echoed Sugarman's sentiments:

“Solicitors have long been banned from making unsolicited texts and calls, but it is clear that data for cold calls is mined, sold and re-sold by a variety of organisations across the personal injury sector. CMCs are undoubtedly the worst offenders, but they are not alone.
“The only solution is a complete ban on unsolicited texts and cold calls. If the current regulatory regime does not have the legal powers, we shall continue to press for a commitment to ban them under the stronger powers available to the Financial Conduct Authority once it takes full responsibility for regulating claims management companies from April 2018.”

Dinner time interruption

We’ve all been there, just as we are tucking into our evening meal the phone rings with someone on the other end trying to help you uncover a repressed memory of an accident you suffered in the last three years.

Often these pillars of the community disappear as quickly as they appeared if questioned on how they came across your details. It’s these CMCs who are the real threat, with no concern whether the injury details are legitimate or not.

Ban on cold calling

Financial & Legal is firmly behind the campaign to ban cold calling, and with over 30 years of service under our belts, we are proud to have never participated in the practice. Unfortunately, shameless CMCs will continue to harass the general public in making spurious claims which cast aspersions on the industry.

If you are receiving nuisance calls you can register free of charge with the Telephone Preference Service (TPS) or the Corporate Telephone Preference Service (CTPS).
